Conveyancing Has Changed
The Recorder of Titles has now issued Directions to the Conveyancing profession. These Directions are enforceable from the 7th March 2024.
What does this mean for you?
It means that there are certain steps we must undertake as part of your transaction, which are required by law. This may mean that if your settlement occurs on or after the 7th of March 2024, we are going to need some more documents from you.
These steps include verifying your identity, verifying your right to deal in a transaction and obtaining a Client Authorisation Form.
Verification of Identity
As a result of the new Directions, every Client will need to undertake a Verification of Identity (VOI). This is to ensure there is a real person behind the transaction. This prevents any fraud or loss from occurring.
We will require from you, through our third-party provider, a real-time copy of your Passport, your Driver’s Licence and a passport-style photo.
There is a scale of documents we can accept, but best practice dictates we use the above.
Right to Deal
As a result of the new Directions, every Client will need to evidence their Right to Deal in a transaction (either to purchase or sell the Property).
There are certain documents we will ask you for during the transaction, which could include a Rates Notice, Land Tax Notice or a copy of your Home Insurance Policy.
Client Authorisation Form
As a result of the new Directions, every Client will need to sign a Client Authorisation Form, which will allow us to complete your transaction.
This is a simple document which we will have prepared for your signature. We’ve tested it, and we promise it’s easy!
